据美团官方报道，近日河南省南阳市公安局官方微信公众号通报：河南省西峡县一男子利用外卖平台保障机制吃“霸王餐”40余次，每次均以“未收到货”为由向平台发起退款，最终因涉嫌诈骗被当地派出所依法行政拘留。

目前，该用户的美团账户已被限制下单。

据悉，2025年9月3日，西峡县五里桥派出所接到一外卖员报警称，其配送的一单外卖已送达，但顾客李某却向外卖平台发起退款理由竟是“未收到货”。

接警后，民警立刻展开调查，通过调取小区监控、走访周边美团外卖站点、询问多名外卖员，最终确认李某本人已收到外卖。

民警进一步深挖发现，自今年5月份以来，李某利用美团小额退款审核宽松的漏洞，竟以相同手法累计发起恶意退款40余次，非法牟利400余元。

目前，李某因涉嫌诈骗已被依法行政拘留。

需要注意的是，近年来随着外卖行业的蓬勃发展，类似恶意退款、虚假投诉等行为时有发生。

警方提醒广大消费者：

诚信消费，拒绝侥幸：平台规则是权益保障，而非“薅羊毛”漏洞，滥用将面临法律追责；

理性维权，依法行事：如遇配送问题，应第一时间与平台、骑手沟通，通过正规渠道解决；
